I just came onto the list late guys sorry, I can't help the guys out
now since it is already after five p.m.
The fair should be able to simply ad them onto their policy, however
they will more than likely charge them $125.00 to do so which will no
doubt put a big dent into their paycheck since they apparently knew
nothing of this clause in enough time to negotiate more payment to pay
for it. If they do get offered that alternative it is still cheaper
than buying the insurance policy which they don't need unless they
intend to play a lot more gigs like this in year.
Yes it is becoming a standard practice for all independent contractors
dealing with State and County organizations on State, City and County
Property. Some lawyer has no doubt convinced them that a snapped
banjo string might actually hurt someone, or maybe wrong notes would
damage someone's ears and destroy their perfect pitch in the audience
of course. And Gawd forbid a flying thimble or spoon hit someone.
If the guys HAD CALLED ME THIS MORNING I PROBABLY COULD HAVE FIXED IT
FOR THEM, BUT AM NOW OUT OF TIME,
In the future if anyone else has this situation contact me ahead of
time and I can help you by adding you onto my policy the same way they
will on the fair policy if they will do it. I have the same policy
that they do :)) As well as Liquor Liability, so if anybody wants to
do an event together I have a non-profit and liquor liability and
general liability Insurance of $3,000,000.00 and a membership in the
Fair Association, which will satisfy anybody's requirements. You
could contract your dates thru my organization and the costs for doing
so would be tax deductible for you as a donation to our Jazz for kids
program and you might even get a gig thru it to pay you back :))
Anybody need some help with this let me know and I'll try to explain
all the gory boring details to you. USA only please, and preferably
the seven Western most states where most of our members are located and
covered by the same master policy.
I can also show you how to get your own policy as a bandleader as well,
It will cost you about $1000.00 a year and depending upon the event
it could cost you an additional $100.00 per event to include the Fair
or venue to the policy per event.

A couple of years ago I had a trio doing a private gig at a Casino at
North Shore Tahoe. As we were bringing in our equipment, someone from
the hotel/casino told us the same thing. Luckily the client who hired
us, who owned a large computer company, got it fixed. I don't know if
he threatened to pull his party out or if he got us covered under his
own business liability insurance.
That is the only time so far that I have run into this situation.
There was quite a discussion on this topic here on DJML a year or two
ago. I am sure some listmates, especially Tom and Steve, will have
plenty to say about this.
