The Men At Work flute solo has just the first 2 measures of the melody  
- not the entire thing.

  In a song full of Australian cultural references it would be hard to  
not have a Kookaburra singing, a tied down Kangaroo, or a Waltzing  
Matilda in there somewhere.  I think they will win on appeal.

By the way, the melody of the older song is a variation on the natural  
call of the bird - at least that is what I was told in elementary  
school - you listen for yourself:
