Spot on Dave, especially since if one googles Dykes of Dixieland, or
Dykes of Dixieland + 3, Goggle asks you right away if you meant Dukes
of Dixieland. No doubt a trademark infringement suit could be brought
and would probably succeed on the basis of confusion over a
trademarked name with just a one letter difference. "Dixie" and
"Dixieland" may not be copyrightable, however as band names, "Dukes of
Dixieland", or "Original Dixieland Jazz Band", "Bobcats", et al are.
Seems to me there was a trademark battle going on between the current
Dukes of Dixieland and The Real Dukes, led by list mate Mike Marois
who plays tuba with the Real Dukes, and is the Nephew of Frank and
Freddie Assunto and grandson of Papa Jac Assunto. I'm not sure how it
all turned out.
