To me, this is a silly discussion.  

For starters, copyright law does allow use of a certain, limited amount of a work without any payment, under fair use laws.

Hopefully, when a player of any KOM quotes, it's no more than a couple of bars.  Any more than that is somewhat silly, IMO.

But, since we all play only in places that pay ASCAP and BMI, it's a moot point anyway.  Any use is covered.
