Hi Jim:

  I won't speak for Mike here, however I certainly understand his 
viewpoint and in a perfect and legitimate world he is absolutely 
correct, unfortunately the business just generally does not work like 
that.

As for the re-sale of the used CDs, phonograph records, or cassettes, 
the artist allegedly got paid the royalties for the original sale of 
that particular piece of product.  Whether it actually ever made it to 
his bank account is however debatable as has been discussed on this 
list many times.  I believe the law is not being broken here as it is 
merely the sale of second hand merchandise, however one must look at 
the probability that the Tax man is dipping into it again for his cut.  
  You could compare this to the resale of an automobile,  Mr. Ford made 
his profit on the first sale of the Automobile but does not get a 
royalty from it when it is sold again as a used car.

There oughta be a LAW ????   there no doubt is.   But me thinks we 
certainly do have far too many laws already which is why we have so 
many criminals and lawbreakers.  Tain't none of us Perfect is we?

That being said however there will always be legitimate honest people 
to buy good product, if we seek them out and sell it to them.    I 
still say that the market for OKOM is in the AARP  newsletter where you 
could sell far more Big band Cds and Dixieland Cds than ANY MAJOR LABEL 
is ever gong to sell if they signed you to their label.    They are 
still hung up on selling only to the Real Recording buyers as far as 
they are concerned:  Age 13-25 years old.   They can't see anybody over 
25 as a potential customer in enough numbers to make a profit.   They 
have been idiots on this matter for as long as I have been in the 
business.
