Hi Mike:

No I did not forget, but it is highly doubtful that they are copying
ours, since most of them never heard of any of us and or our music, I
welcome them copying mine, I can use all the publicity I can get. The
studies on this issue are reflecting that yes there is some widespread
copying being done and song sharing, but the same thing is done weekly
on this list by esteemed friends with sheet music, out of print
recordings, and maybe even fake books. If more OKOM AND JAZZ ACTS
WOUILD ACTUALLY PROMOTE THIER MUSIC it could become a problem, Again
We should all be so lucky. Just think there might even be more LIVE
Music gigs available as a result of a new generation discovering our
music.

What I was referring to was the power of the internet available to ALL
of us to allow us to use it to make money and promote ourselves
directly to consumers at the retail level to sell product without
having all the money siphoned off by major labels, distributors and
sharks that have controlled the music industry for so many years.

I find it very interesting to get reports of how many sales some
artists have made independently of their recordings far far in excess
to the numbers ever provided to them by their Major labels much less
royalties that evaporated into thin air to pay off so called expenses
of the record label.

There are some very excellent ways to market your CDs on the internet
that result in your getting paid, but like anything else you have to be
diligent and research the sites and check them out for honesty and
integrity the same as you should check out any So called Record
Distributor for the retail store. If the Internet system were as bad
as the Majors and RIAA would have the public believe then they would
have already been out of business, instead they are still selling
millions of units and have actually been joining the download game
since they discovered what a great promotional tool it can be.

Earlier this year I consulted on a project with an artist & his
manager, that had a couple of hit songs and he was chased by a Major
Jazz label for a contract, which I advised them not to sign as it
contained a clause that said he was to turn over 10,000 CDs that he
still had of his latest release with the hits on it to them to be used
as "Promotional copies ONLY" they would manufacture new ones for
distribution with their label information on them for the retail
outlets. Well long story short, since he was lazy and no longer
wanted to pursue selling his own merchandise at retail prices and
making more money than he had ever made on any previous recordings, he
signed the contract and turned over all the CDs to them. They
distributed them to the retail outlets and SOLD all of them and never
manufactured any additional CDs of his product, and then cancelled his
contract with an out clause concerning label cutbacks. :)) By the way
they had rejected his offer to sign with them when he first made the
CD. :))

This artist was consistently selling about $2,000. worth of product by
himself at concerts for cash at the time, and had not even yet begun to
tap into the Internet system available to sell them. He now has no
manager, and no label, and no product, no booking agent, and not many
gigs AGAIN. He also owed his last manager a lot of money which he
will never see.

Cheers,

Tom Wiggins

You think the major labels are not shaking in their boots these days,
think again, they can file all the lawsuits they want but they can't
beat the people with the computers Hell bent on kicking their greedy
asses at every given opportunity.

Ah Tom, but you forget one thing. The SAME kids who are smart enough
to get
by the protections from the major labels are copying OUR CD's (if they
even
listen to any of our music) and robbing from us. They have no
scruples. It
has nothing to do with getting even with the major labels and
everything to
do with then just figuring that they can steal from anybody.
