The Miller comparison doesn't hold much sway...
The Miller estate does authorize a ghost band, no matter who is leading it. Remember Ray Eberle??
But, when the Miller Band tours, it's as a group, not just a few key personnel. They aren't full time, but might be out for 6-8 weeks at a time. The personnel could change from tour to tour, but the instrumentation, concept, sound, and arrangements will be the same.
And, heck, what if the leader of any band is sick, has a gig, and finds a sub? Or has to have 4 subs for whatever? As long as the band is good, professional, and agrees to be called whatever, no harm done. As long as the booking is done with those understandings, to both the musicians and the customer.
